statement to demonstrate its firm commitment to protecting
its users' privacy. The following paragraphs describe how information is gathered and disseminated by
SurveyShare.

SurveyShare is a survey clearinghouse and Web hosting service. We do not censor the questions or
messages in the surveys or the invitations to take surveys that third parties may propound, nor do we
censor the responses you may provide. As detailed below, members of this service who send our
Web-based surveys are solely responsible for the subject matter, questions, and contents of any survey
invitations and surveys in which they participate. In addition, they are solely responsible for the
contents of their survey responses.
Account Information
SurveyShare collects contact information from its users, such as name, address, email address, etc.,
in order to confirm your registration, deliver newsletters that you request, deliver information to
you about our company's services, products and site, allow use of the survey creation and analysis
features, and to customize and personalize your SurveyShare user experience. This information is
stored in a secure online database. Information that is supplied to SurveyShare through our online
registration forms and other places throughout the site will be used to communicate with the visitor
when necessary. This information may also be used to provide goods and/or services to a customer,
after the goods and/or services have been ordered by the customer. Financial information (like credit
card numbers) that the user provides will used to bill for products and services, and will be
available to our credit card service and fulfillment companies. You will only be billed for items and
services that you order. We reserve the right, even after a user has canceled all accounts with us,
to send email and print communications to them describing this and other services offered by
SurveyShare.
Surveys and Newsletters
We sometimes use our member database to solicit participants in our online survey research or to
request feedback on new services, tools, and events. If solicited to participate in any of these
surveys, any member can decline participation. We also will occasionally offer online newsletters,
which are opt-in only and can be unsubscribed from at any time.
Server Traffic
Like the vast majority of complex Web sites, SurveyShare tracks user traffic through our Web site
servers. We might utilize information such as your IP address to help diagnose technological
problems, and other Web site administrative activities. Your IP address may also be utilized in order
to customize information sent to you in order to make it as relevant as possible. We might also
release aggregate traffic pattern data in order to describe our services to prospective partners,
advertisers, third parties, or for any other lawful purpose. We reserve the right to perform
statistical analysis of user behavior and characteristics in the effort to improve our system's
performance and our marketing efforts.
Surveys and Sharing
SurveyShare allows users to input the e-mail addresses of other individuals in order to allow the
SurveyShare system to send out invitations to those individuals, and checks these email addresses
when invitees attempt to respond to surveys. E-mail addresses collected in this manner will not be
used in any way by SurveyShare, other than in the administration of that user's surveys, and will not
be shared or sold to others.
SurveyShare also allows users to share their survey data, including questions and user responses,
which may include personal information, with others. The user must specifically choose to share their
results or survey templates. SurveyShare is not responsible for decisions made my SurveyShare
members to share their results or survey templates or any ensuing sharing between and among members.
SurveyShare also is not responsible for the content of users' survey questions, nor is it responsible
for the responses to these questions given by survey invitees. However, we reserve the right to
review the contents of our Web server and to delete any surveys, and the user accounts associated
with them, without warning or advance notice, if it appears that our Terms of Service are violated.
When a survey is created, it is given a unique URL (Web address) which is not shared with any other
survey. SurveyShare does not claim any ownership rights to the contents of the surveys created by
users, or of the data associated with them. This private URL will not be distributed to others by
anyone other than the survey creator.
Members can access surveys they have built as well as associated data or results through their
individual accounts and lockers protected by a password that they have selected. We will store the
survey results in our database, for which we have made a good-faith effort to secure from outside,
unauthorized access, but SurveyShare cannot be held liable in the event of unauthorized access to
user files by outside parties. We will prosecute, to the fullest extent of the law, any unauthorized
attempt to gain access to the data on our servers or to disrupt the operations of this online system.
While we will do our utmost to ensure the reliability of our servers, users agree that SurveyShare
cannot be held liable for data loss or data corruption.
Cookies
SurveyShare, like most commercial sites, uses cookies (small text files stored on the user's
computer) to provide users with convenient, automatic login and access to the site. These cookies
allow your browser to remember your user name and password so that you do not have to constantly
login over and over again. Also, SurveyShare uses cookie technology to track participants'
interactions with the site and its other users in order to ensure a high quality experience for all
users. As you explore the site, you can sign off at any time by clicking the "Log Out" link at the
top of each page. Most modern web browsers allow for the easy deletion of unwanted cookies; however,
deleting SurveyShare cookies may compromise site performance and ease-of-use.
Off-Site Resources
This Web site contains many links to other Web sites, many of them added by our users.
SurveyShare is not responsible for either the content (accuracy, appropriateness, copyright
ownership, legality, etc.) or the privacy practices of these other Web sites.
Discussion Forums
Please remember that the discussion forums (bulletin boards) and chat rooms on SurveyShare are public
forums. Any information that you disclose in any public areas of this Web site, such as discussion
forums, chat rooms, and public profile pages, becomes public information. You can modify or change
information on the public area of your profile page at any time after your registration is complete.
Just as with any other site on the Internet, you should exercise caution about revealing personal
information. SurveyShare reserves the right to remove any posting that its editors consider
inappropriate or for any other reason.
Site Security
SurveyShare has implemented security measures to protect the loss, alteration or misuse of the
information stored on its sites. Secure Socket Layer technology is used for transferring orders. As
a result, you can purchase from us with confidence that your data is secure. We contract with an
outside company, Verisign, to provide secure credit card approval.
Survey Results
When your survey results are received by us, we will store them in a secure location. Still, it's
your data. We will not attempt to read or access your survey results at any time unless explicitly
instructed to do so by you. SurveyShare does not own the contents of the data from your survey.
SurveyShare has access to your survey contents purely for purposes of backup and troubleshooting. We
have security measures in place to protect your results while stored on our servers and we will
prosecute any attempt to access this information without authorization to the fullest extent of the
law.
Children's Privacy Policy
SurveyShare is primarily designed to be a data gathering and reporting tool for higher education
institutions, corporate entities, non-profit and military organizations, government agencies,
community services organizations, and other educational and training environments. SurveyShare
subscriptions and free membership services are not available to children under age 18. This survey software is
not designed for the use of minor children and no one under 18 is authorized to utilize the site.
Anyone using this site promises and warrants that they are 18 years of age or older. We do not want
to collect any personal information whatsoever of minors. In fact, we ask that minors do not submit
any information about themselves and that they not use the SurveyShare survey software Web site. Anyone using this
Web site or our services warrants and promises that they are 18 years of age or older.
Information Sharing and Disclosure
SurveyShare will not sell or rent information that identifies you personally to anyone other than our
exclusive partners, except that SurveyShare may send personally identifiable information about you to
other companies or people under one or more of the following conditions:
- You have consented to share the information;
- We are required to share your information to provide the goods or services you have ordered;
- We are legally required respond to subpoenas, court orders or legal processes; or
- We find that your actions on our Web sites violate the SurveyShare
Terms of Service.

Upon request, and with a reasonable time to respond, SurveyShare will allow users to cancel their

Notification of Changes
The above policies are effective as of January 1, 2003. SurveyShare reserves the right to change
these policies at any time, without advance notice. If there are material changes in the Privacy
Policy, SurveyShare will attempt to notify all registered users of these policy changes in a
reasonable time directly via email at the email address provided to SurveyShare by registered users
as well as prominently posting new policies at the SurveyShare Web site for at least 30 business days
prior to the implementation of the new practice. Both the email to registered users and the notice
on our Web site will explain how to notify us if a user objects to the new practice(s) and wishes to
prevent such use.
Your Acceptance of These Terms
