SurveyShare Anti-Spam Policy

SurveyShare was developed to help individuals and organizations effectively communicate with their various constituencies to improve training and education, research, decision-making, products, services, and relationships, but ONLY with the mutual consent of the parties involved. Member acknowledges and agrees that SurveyShare is serving as "survey host" and is not the sender or originator of any survey. SurveyShare's Web hosting tool for survey invitations supports ONLY permission-based email marketing and research practices. Because of this commitment, SurveyShare has implemented this Anti-SPAM policy to:

  1. Help prevent SurveyShare from being used to send unsolicited e-mails or email campaigns.
  2. Respond to complaints suggesting that SurveyShare and related Web sites and tools have been used as a
  3. vehicle to send unsolicited email or links included in unsolicited mail.
  4. Clarify our policies and procedures related to unsolicited email.

SurveyShare does not permit the use of its site and related Web sites and tools for Unsolicited Commercial Email (UCE) or what is commonly referred to as SPAM. What is SPAM? Simply put, SPAM is the equivalent of junk mail that is sent to someone without his or her prior consent or in the absence of a previous relationship with the sender.

SurveyShare recognizes that SPAM is a pervasive and growing problem on the Internet. SPAM can deluge a recipient's email box to the point that it overwhelms legitimate email. Consequently, SurveyShare has zero tolerance for SPAM, junk mail, pyramid schemes, or UCE that are in any way associated with SurveyShare, its clients, or any of its clients' associates. You are prohibited from using UCE as a means of conducting surveys hosted on SurveyShare's network. Without limitation, subscribing members and organizations may not use the "tell a friend about SurveyShare" feature of the services to send email communications to a prospective member unless they have a reasonable basis to believe that the recipient will want to become a member. Infringements of SurveyShare's Anti-SPAM policy include, but are not limited to:

  1. Sending, being involved in sending, or employing a third party to send mail which advertises or mentions a survey hosted at SurveyShare to users that have not specifically requested this type of mail. This includes bulk email from lists that have been gathered accidentally, unintentionally, inappropriately, or unlawfully.
  2. Forging of message headers to mask the originator of the message.
  3. Harassment, whether through language, frequency, or size of messages.
  4. Bulk email intended to purposely slow or constrain the SurveyShare system.

Generally speaking, SPAM does not include sending surveys or email notifications of surveys to employees, business partners, students, friends, customers, members, any other group that you communicate with on an ongoing or regular basis, or the use of "opt-in" lists of people willing to take surveys. Such lists might include the following:

  1. Customer, employee, or colleague lists.
  2. Lists rented from e-mail or list service providers who assure opt-in or double opt-in inclusion, and
  3. Where the service providers have provided clear opt-out or unsubscribe opportunities.
  4. Opt-in lists you develop or have developed for survey panels, newsletters, newsgroups, or user groups.

The use of student lists for research purposes may require permission from a Human Subjects Review Board of an organization of institution. SurveyShare shall not be held liable if the user fails to obtain proper Human Subjects Approval for a study.

  1. The following sources of e-mail lists are usually NOT acceptable:
  2. Lists generated with web spiders.
  3. E-mail addresses collected from discussion lists or newsgroups.
  4. Lists generated with e-mail address collector programs.
  5. Lists obtained accidentally, unintentionally, inappropriately, or unlawfully.

Generally speaking, any list created in a way that does not offer choice about inclusion is considered a SPAM list. If you have a question about whether your e-mail list is appropriate, please ask our customer service department at customerservice@SurveyShare.com.

Member Conduct It is important for all potential SurveyShare members to read and understand the "no spamming policy" section within our Terms of Agreement. By accepting the terms, members warrant and promise that they either have an ongoing business or personal relationship with those on the email list, or have obtained consent to send emails inviting participation in a survey to the persons on the member's own email list or such lists purchased from a third party.

Responding to SPAM Complaints If SurveyShare or our Internet Service Provider receives more than one complaint about SPAM or UCE directly related to your use of our service or email invitations for your surveys hosted on our service, regardless of the source of your email list, we reserve the right to immediately and permanently shut down your account without refund.

If you have breached the Terms of Agreement regarding no spamming, we will terminate your e-mail job, if it is still running, without refund. In addition, we will bar you from future use of any SurveyShare product or service. We will also charge you for all costs associated with investigating and prosecuting you for misuse of our products and services. If member attempts to engage in spamming a second time using the same or different account, SurveyShare will report such conduct to the appropriate authorities and turn over any and all information, including personally identifying information, to appropriate persons or entities.

Think You've Been Spammed? If you are unsure whether any contemplated use of email is permitted, please send mail to abuse@SurveyShare.com and we will assist you. Please forward a copy of the unsolicited email to abuse@SurveyShare.com and provide any other information that you believe may help us in our investigation. Include the email address to which the message was sent and any other identifying information. We will make every effort to track down the offending party or parties and bring a halt to their spamming efforts.
